Bepalings en voorwaardes

§1 General Provisions

1. The BMS-EV online store available at bms-ev.com is operated by:

2. These terms and conditions define the rules for using the online store, placing orders, product delivery, payments, complaints and returns.
3. The Customer is obliged to read the terms and conditions before placing an order.

§2 Definitions

1. Store – the BMS-EV online store available at bms-ev.com
2. Seller – Clima Boost Jakub Lipinski
3. Customer – a natural person, legal entity or organizational unit making purchases in the Store
4. Consumer – a natural person making a purchase unrelated to business activity
5. Product – goods available in the Store
6. Order – a declaration of intent by the Customer to conclude a sales contract

§3 Ordering Rules

1. Orders can be placed 24 hours a day, 7 days a week.
2. To place an order:
   • select the product and add it to the cart
   • fill in the order form (shipping and billing details)
   • choose payment and delivery method
   • confirm the order
3. After placing the order, the Customer receives a confirmation email.
4. The sales contract is concluded when the order is confirmed by the Seller.

§4 Prices and Payments

1. Prices in the Store are gross prices (including VAT).
2. The price shown with the product is binding at the time of order.
3. Available payment methods:
   • PayPal (credit cards, PayPal account)
   • Bank transfer
4. The Store accepts payments in: PLN, EUR, USD.

§5 Delivery

1. Delivery is made to the address provided by the Customer.
2. Order processing time: 3-7 business days (Poland), 5-14 business days (Europe), 7-21 business days (rest of world).
3. Shipping costs are displayed in the cart before checkout.
4. The Seller is not responsible for delays caused by the carrier.

§6 Right of Withdrawal

1. The Consumer has the right to withdraw from the contract within 14 days without giving a reason.
2. The withdrawal period runs from the day of receiving the product.
3. To exercise the right of withdrawal, please inform the Seller by email: office@bms-ev.com
4. The Consumer bears the direct costs of returning the product.
5. The Seller refunds payment within 14 days of receiving the returned product.
6. The right of withdrawal does not apply to products made to the Customers special order.

§7 Complaints and Warranty

1. The Seller is liable for product defects under warranty for 2 years from the date of purchase.
2. Products are covered by manufacturer warranty according to the warranty card terms.
3. Complaints should be sent to: office@bms-ev.com
4. Complaints will be processed within 14 days of receipt.

§8 Personal Data

1. The data controller is Clima Boost Jakub Lipinski.
2. Personal data is processed to fulfill orders in accordance with the Privacy Policy.
3. The Customer has the right to access, correct and delete their data.

§9 Final Provisions

1. The Seller reserves the right to change these terms.
2. Polish law applies to matters not regulated.
3. Disputes shall be settled by the court competent for the Sellers registered office.
4. These terms are effective from 23.12.2024.
